This case is brought by the Center for Constitutional Rights on behalf of lawyers and others working with the Guantanamo Bay prisoners. It is based on the chilling effect on their ability to defend their clients due to the targeted warrantless wiretapping by the NSA that has been admitted by the President.

It has been held by the Ninth Circuit Court of Appeals pending the Supreme Court's decision in Amnesty Internation v. Clapper.
