After the government appeals the lower court decisions in Doe I and Doe CT holding the NSL statute unconstitutional, Congress amends the statute in the USA PATRIOT Act Additional Reauthorizing Amendments Act of 2006. Because the amendments apply retroactively, the U.S. Court of Appeals for the Second Circuit holds that the amendments rendered the decision in Doe I moot as to Fourth Amendment claims and raised novel First Amendment issues as well as rendering the decision in Doe CT moot.
