Using flawed constitutional analysis, the review board concludes that "the core of [the] program" is constitutional. While the Board acknowledges that "certain aspects of the program’s implementation raise privacy concerns," and may push the program "across the threshold of unreasonableness", the Board recommends only minimal procedural changes to the program.
